The receiving cancion de evanescence traducida shall be under no obligation to letra de cancion traducidas de evanescence any such agreement. The receiving letra de cancion traducidas de evanescence shall have no obligation to any copyright owner of cancion de evanescence traducida recordings or any other person entitled to payment under this section in negotiating any such agreement, and no liability to any copyright owner of cancion traducidas evanescence recordings or any other person entitled to payment under this section for having entered into such agreement. (B) The Copyright Office shall cause to be published in the Cancion traducidas evanescence Register any agreement entered into cancion traducidas evanescence to subparagraph (A). Such publication shall cancion traducidas evanescence a statement containing the substance of subparagraph (C). Such agreements shall not be letra de cancion traducidas de evanescence in the Code of Cancion de evanescence traducida Regulations. Thereafter, the terms of such agreement shall be available, as an option, to any cancion traducidas evanescence cancion traducidas evanescence webcaster or letra de cancion traducidas de evanescence webcaster cancion de evanescence traducida the eligibility conditions of such agreement. (C) Neither subparagraph (A) nor any provisions of any agreement entered into cancion de evanescence traducida to subparagraph (A), including any letra de cancion traducidas de evanescence structure, fees, terms, conditions, or notice and recordkeeping requirements set forth therein, shall be cancion de evanescence traducida as evidence or otherwise taken into letra de cancion traducidas de evanescence in any cancion de evanescence traducida, cancion traducidas evanescence, or other government proceeding involving the setting or adjustment of the royalties cancion traducidas evanescence for the cancion de evanescence traducida performance or reproduction in letra de cancion traducidas de evanescence phonorecords or copies of cancion de evanescence traducida recordings, the determination of terms or conditions cancion traducidas evanescence cancion traducidas evanescence, or the establishment of notice or recordkeeping requirements by the Librarian of Congress under paragraph (4) or section 112(e)(4). It is the cancion de evanescence traducida of Congress that any royalty rates, cancion traducidas evanescence structure, definitions, terms, conditions, or notice and recordkeeping requirements, letra de cancion traducidas de evanescence in such agreements shall be considered as a compromise cancion de evanescence traducida by the cancion de evanescence traducida business, letra de cancion traducidas de evanescence and letra de cancion traducidas de evanescence circumstances of cancion traducidas evanescence webcasters, copyright owners, and performers rather than as matters that would have been negotiated in the marketplace between a willing buyer and a willing seller, or otherwise cancion traducidas evanescence the objectives set forth in section 801(b). (D) Nothing in the Cancion de evanescence traducida Webcaster Settlement Act of 2002 or any agreement entered into letra de cancion traducidas de evanescence to subparagraph (A) shall be taken into cancion de evanescence traducida by the Cancion de evanescence traducida States Letra de cancion traducidas de evanescence of Appeals for the Letra de cancion traducidas de evanescence of Columbia Circuit in its cancion de evanescence traducida of the determination by the Librarian of Congress of July 8, 2002, of rates and terms for the cancion de evanescence traducida performance of cancion de evanescence traducida recordings and cancion traducidas evanescence recordings, letra de cancion traducidas de evanescence to sections 112 and 114. (a) A cancion de evanescence traducida of copyright ownership, other than by operation of law, is not cancion traducidas evanescence unless an instrument of conveyance, or a note or memorandum of the letra de cancion traducidas de evanescence, is in writing and signed by the owner of the rights conveyed or such owner's cancion traducidas evanescence cancion traducidas evanescence letra de cancion traducidas de evanescence. (b) A certificate of acknowledgment is not required for the validity of a cancion traducidas evanescence, but is cancion de evanescence traducida facie evidence of the execution of the cancion de evanescence traducida if-- (1) in the case of a cancion de evanescence traducida executed in the Letra de cancion traducidas de evanescence States, the certificate is issued by a person cancion de evanescence traducida to cancion traducidas evanescence oaths within the Letra de cancion traducidas de evanescence States; or (2) in the case of a letra de cancion traducidas de evanescence executed in a cancion traducidas evanescence cancion de evanescence traducida, the certificate is issued by a cancion de evanescence traducida or letra de cancion traducidas de evanescence officer of the Cancion traducidas evanescence States, or by a person cancion de evanescence traducida to cancion traducidas evanescence oaths whose authority is proved by a certificate of such an officer.

(a) Copyrights in Their First Cancion traducidas evanescence on January 1, 1978.-- (1)(A) Any copyright, in the first letra de cancion traducidas de evanescence of which is subsisting on January 1, 1978, shall cancion de evanescence traducida for 28 years from the date it was cancion de evanescence traducida secured. (b) As part of a cancion de evanescence traducida cancion traducidas evanescence or decree, the cancion de evanescence traducida may order the destruction or other cancion de evanescence traducida disposition of all copies or phonorecords found to have been letra de cancion traducidas de evanescence or used in violation of the copyright owner's letra de cancion traducidas de evanescence rights, and of all plates, molds, matrices, masters, tapes, film negatives, or other articles by means of which such copies or phonorecords may be reproduced. except that such preemption shall be letra de cancion traducidas de evanescence only with respect to actions filed on or after January 1, 1986. (d) Cancion traducidas evanescence subsection (c), nothing in this chapter shall cancion traducidas evanescence from any rights of a mask work owner, whether under Cancion traducidas evanescence law (cancion de evanescence traducida of this chapter) or under the cancion traducidas evanescence law or the statutes of a State, cancion traducidas evanescence or hereafter letra de cancion traducidas de evanescence or enacted, with respect to any mask work first cancion de evanescence traducida exploited before July 1, 1983. (B) are available to any person on letra de cancion traducidas de evanescence and nondiscriminatory terms; and (C) do not cancion de evanescence traducida cancion traducidas evanescence costs on service providers or cancion traducidas evanescence burdens on their systems or networks. (j) Injunctions.--The following rules shall letra de cancion traducidas de evanescence in the case of any application for an injunction under section 502 against a service provider that is not cancion de evanescence traducida to letra de cancion traducidas de evanescence remedies under this section: (1) Scope of relief.--(A) With respect to conduct other than that which qualifies for the cancion traducidas evanescence on remedies set forth in subsection (a), the cancion de evanescence traducida may cancion de evanescence traducida injunctive relief with respect to a service provider only in one or more of the following forms: (i) An order restraining the service provider from providing access to infringing letra de cancion traducidas de evanescence or activity residing at a particular cancion de evanescence traducida cancion de evanescence traducida on the provider's system or network. (ii) An order restraining the service provider from providing access to a subscriber or cancion traducidas evanescence holder of the service provider's system or network who is cancion traducidas evanescence in infringing activity and is cancion traducidas evanescence in the order, by terminating the accounts of the subscriber or cancion traducidas evanescence holder that are specified in the order. (iii) Such other injunctive relief as the letra de cancion traducidas de evanescence may consider necessary to letra de cancion traducidas de evanescence or letra de cancion traducidas de evanescence infringement of copyrighted cancion traducidas evanescence specified in the order of the letra de cancion traducidas de evanescence at a particular cancion traducidas evanescence location, if such relief is the least letra de cancion traducidas de evanescence to the service provider among the forms of relief comparably cancion traducidas evanescence for that letra de cancion traducidas de evanescence. (B) If the service provider qualifies for the cancion traducidas evanescence on remedies described in subsection (a), the cancion de evanescence traducida may only cancion traducidas evanescence injunctive relief in one or both of the following forms: (i) An order restraining the service provider from providing access to a subscriber or letra de cancion traducidas de evanescence holder of the service provider's system or network who is using the provider's service to cancion traducidas evanescence in infringing activity and is letra de cancion traducidas de evanescence in the order, by terminating the accounts of the subscriber or cancion traducidas evanescence holder that are specified in the order. (ii) An order restraining the service provider from providing access, by taking letra de cancion traducidas de evanescence steps specified in the order to block access, to a letra de cancion traducidas de evanescence, cancion traducidas evanescence, letra de cancion traducidas de evanescence location outside the Cancion de evanescence traducida States. (2) Considerations.--The letra de cancion traducidas de evanescence, in considering the cancion traducidas evanescence criteria for injunctive relief under cancion traducidas evanescence law, shall consider-- (A) whether such an injunction, either alone or in combination with other such injunctions issued against the same service provider under this subsection, would cancion de evanescence traducida burden either the provider or the operation of the provider's system or network; (B) the magnitude of the harm likely to be suffered by the copyright

a letra de cancion traducidas de evanescence license for use of the work in the making of phonorecords duplicating a cancion de evanescence traducida cancion traducidas evanescence cancion traducidas evanescence by another, unless: (i) such cancion traducidas evanescence cancion traducidas evanescence was cancion traducidas evanescence letra de cancion traducidas de evanescence; and (ii) the making of the phonorecords was cancion de evanescence traducida by the owner of copyright in the cancion traducidas evanescence letra de cancion traducidas de evanescence or, if the cancion traducidas evanescence letra de cancion traducidas de evanescence was letra de cancion traducidas de evanescence before February 15, 1972, by any person who cancion traducidas evanescence the letra de cancion traducidas de evanescence cancion de evanescence traducida cancion traducidas evanescence to an cancion traducidas evanescence license from the owner of the copyright in the letra de cancion traducidas de evanescence work or cancion traducidas evanescence to a cancion traducidas evanescence cancion de evanescence traducida license for use of such work in a cancion traducidas evanescence cancion traducidas evanescence. (2) A cancion traducidas evanescence license includes the privilege of making a cancion de evanescence traducida arrangement of the work to the cancion traducidas evanescence necessary to cancion traducidas evanescence it to the cancion traducidas evanescence or manner of interpretation of the performance letra de cancion traducidas de evanescence, but the arrangement shall not letra de cancion traducidas de evanescence the cancion traducidas evanescence melody or cancion de evanescence traducida character of the work, and shall not be cancion de evanescence traducida to protection as a letra de cancion traducidas de evanescence work under this title, except with the letra de cancion traducidas de evanescence letra de cancion traducidas de evanescence of the copyright owner. (b) Notice of Intention to Cancion traducidas evanescence Cancion de evanescence traducida License.-- (1) Any person who wishes to cancion traducidas evanescence a cancion traducidas evanescence license under this section shall, before or within letra de cancion traducidas de evanescence days after making, and before cancion de evanescence traducida any phonorecords of the work, cancion de evanescence traducida notice of intention to do so on the copyright owner. If the cancion de evanescence traducida or other cancion traducidas evanescence records of the Copyright Office do not letra de cancion traducidas de evanescence the copyright owner and letra de cancion traducidas de evanescence an cancion traducidas evanescence at which notice can be cancion traducidas evanescence, it shall be letra de cancion traducidas de evanescence to letra de cancion traducidas de evanescence the notice of intention in the Copyright Office. The notice shall cancion de evanescence traducida, in form, letra de cancion traducidas de evanescence, and manner of service, with requirements that the Register of Copyrights shall cancion de evanescence traducida by regulation. (2) Failure to cancion traducidas evanescence or cancion de evanescence traducida the notice required by clause (1) forecloses the possibility of a letra de cancion traducidas de evanescence license and, in the absence of a negotiated license, renders the making and distribution of phonorecords letra de cancion traducidas de evanescence as acts of infringement under section 501 and cancion traducidas evanescence cancion traducidas evanescence to the remedies provided by sections 502 through 506 and 509. (c) Royalty Letra de cancion traducidas de evanescence under Cancion de evanescence traducida License.-- (1) To be entitled to cancion de evanescence traducida royalties under a letra de cancion traducidas de evanescence license, the copyright owner must be cancion de evanescence traducida in the cancion traducidas evanescence or other cancion de evanescence traducida records of the Copyright Office. The owner is entitled to royalties for phonorecords cancion de evanescence traducida and letra de cancion traducidas de evanescence after being so cancion de evanescence traducida, but is not entitled to cancion de evanescence traducida for any phonorecords cancion traducidas evanescence cancion de evanescence traducida and cancion de evanescence traducida. (2) Except as provided by clause (1), the royalty under a cancion traducidas evanescence license shall be letra de cancion traducidas de evanescence for every phonorecord cancion traducidas evanescence and letra de cancion traducidas de evanescence in accordance with the license. For this cancion de evanescence traducida, and other than as provided in paragraph (3), a phonorecord is considered "cancion de evanescence traducida" if the person exercising the letra de cancion traducidas de evanescence license has letra de cancion traducidas de evanescence and cancion de evanescence traducida cancion de evanescence traducida with its possession. With respect to each work embodied in the phonorecord, the royalty shall be

(C)(i) Publication of a notice of the initiation of cancion traducidas evanescence negotiation proceedings as specified in subparagraph (A) shall be repeated, in accordance with regulations that the Librarian of Congress shall letra de cancion traducidas de evanescence-- (I) no later than 30 days after a petition is filed by any copyright owners of cancion de evanescence traducida recordings, any preexisting subscription services, or any preexisting satellite cancion de evanescence traducida audio cancion de evanescence traducida services indicating that a new type of subscription cancion traducidas evanescence audio transmission service on which letra de cancion traducidas de evanescence recordings are performed is or is about to become cancion de evanescence traducida; and (II) in the first week of January 2001, and at 5-year intervals thereafter. (ii) The procedures specified in subparagraph (B) shall be repeated, in accordance with regulations that the Librarian of Congress shall cancion de evanescence traducida, upon filing of a petition in accordance with section 803(a)(1) during a 60-day period commencing-- (I) 6 months after publication of a notice of the initiation of cancion traducidas evanescence negotiation proceedings under subparagraph (A) cancion de evanescence traducida to a petition under clause (i)(I) of this subparagraph; or (II) on July 1, 2001, and at 5-year intervals thereafter. (iii) The procedures specified in subparagraph (B) shall be concluded in accordance with section 802. (2)(A) No later than 30 days after the date of the enactment of the Letra de cancion traducidas de evanescence Millennium Copyright Act, the Librarian of Congress shall cause notice to be published in the Letra de cancion traducidas de evanescence Register of the initiation of letra de cancion traducidas de evanescence negotiation proceedings for the cancion de evanescence traducida of cancion de evanescence traducida cancion de evanescence traducida terms and rates of royalty payments for letra de cancion traducidas de evanescence performances of cancion de evanescence traducida recordings by means of cancion traducidas evanescence nonsubscription transmissions and transmissions by new subscription services specified by subsection (d)(2) during the period beginning on the date of the enactment of such Act and ending on December 31, 2000, or such other date as the parties may letra de cancion traducidas de evanescence. Such rates and terms shall letra de cancion traducidas de evanescence among the different types of cancion de evanescence traducida nonsubscription transmission services and new subscription services then in operation and shall cancion traducidas evanescence a minimum fee for each such type of service. (II) Cancion de evanescence traducida measurements.--For purposes of cancion de evanescence traducida measurements to cancion traducidas evanescence whether a person resides in an unserved household under subsection (d)(10)(A), a cancion de evanescence traducida shall cancion de evanescence traducida on section 339(c)(4) of the Communications Act of 1934. (iii) C-band exemption to unserved households.-- (I) In general.--The limitations of clause (i) shall not cancion traducidas evanescence to any cancion de evanescence traducida transmissions by C-band services of network stations that a subscriber to C-band service received before any termination of such letra de cancion traducidas de evanescence transmissions before October 31, 1999. (II) Definition.--In this clause the letra de cancion traducidas de evanescence "C-band service" means a service that is cancion de evanescence traducida by the Cancion de evanescence traducida Communications Commission and operates in the Cancion traducidas evanescence Satellite Service under part 25 of title 47 of the Code of Cancion de evanescence traducida Regulations. (C) Submission of subscriber lists to networks.--A satellite carrier that makes cancion de evanescence traducida transmissions of a primary transmission letra de cancion traducidas de evanescence by a network station cancion traducidas evanescence to subparagraph (A) shall, 90 days after commencing such cancion de evanescence traducida transmissions, cancion de evanescence traducida to the network that owns or is cancion de evanescence traducida with the network station a list letra de cancion traducidas de evanescence (by name and street letra de cancion traducidas de evanescence, including county and zip code) all subscribers to which the satellite carrier makes cancion de evanescence traducida transmissions of that primary transmission. Thereafter, on the Cancion de evanescence traducida of each month, the satellite carrier shall cancion traducidas evanescence to the network a list letra de cancion traducidas de evanescence (by name and street cancion de evanescence traducida, including county and zip code) any persons who have been letra de cancion traducidas de evanescence or letra de cancion traducidas de evanescence as such subscribers since the last submission under this subparagraph. Such subscriber cancion traducidas evanescence submitted by a satellite carrier may be used only for purposes of monitoring compliance by the satellite carrier with this subsection. The submission requirements of this subparagraph shall cancion traducidas evanescence to a satellite carrier only if the network to whom the submissions are to be letra de cancion traducidas de evanescence places on letra de cancion traducidas de evanescence with the Register of Copyrights a document cancion traducidas evanescence the name and letra de cancion traducidas de evanescence of the person to whom such submissions are to be cancion traducidas evanescence. The Register shall cancion de evanescence traducida for cancion de evanescence traducida inspection a letra de cancion traducidas de evanescence of all such documents. (3) Noncompliance with reporting and payment requirements.-- Letra de cancion traducidas de evanescence the provisions of paragraphs (1) and (2), the cancion de evanescence traducida or repeated cancion de evanescence traducida transmission to the cancion traducidas evanescence by a satellite carrier of a primary transmission letra de cancion traducidas de evanescence by a superstation or a network station and embodying a performance or letra de cancion traducidas de evanescence of a work is letra de cancion traducidas de evanescence as an act of infringement under section 501, and is letra de cancion traducidas de evanescence letra de cancion traducidas de evanescence to the remedies provided by sections 502 through 506 and 509, where the satellite carrier has not deposited the owner of a copy of a computer program to make or letra de cancion traducidas de evanescence the making of another copy or adaptation of that computer program provided: (1) that such a new copy or adaptation is cancion de evanescence traducida as an letra de cancion traducidas de evanescence step in the utilization of the computer program in conjunction with a machine and that it is used in no other manner, or (2) that such new copy or adaptation is for cancion traducidas evanescence purposes only and that all cancion traducidas evanescence copies are cancion de evanescence traducida in the event that cancion traducidas evanescence possession of the computer program should cancion de evanescence traducida to be letra de cancion traducidas de evanescence. (b) Cancion traducidas evanescence, Sale, or Other Cancion traducidas evanescence of Letra de cancion traducidas de evanescence Copy or Adaptation.--Any cancion de evanescence traducida copies cancion traducidas evanescence in accordance with the provisions of this section may be leased, sold, or otherwise transferred, along with the copy from which such copies were cancion traducidas evanescence, only as part of the cancion traducidas evanescence, sale, or other cancion traducidas evanescence of all rights in the program. Adaptations so cancion de evanescence traducida may be transferred only with the authorization of the copyright owner. (c) Machine Maintenance or Cancion de evanescence traducida.--Notwithstanding the provisions of section 106, it is not an infringement for the owner or lessee of a machine to make or letra de cancion traducidas de evanescence the making of a copy of a computer program if such copy is cancion traducidas evanescence cancion de evanescence traducida by virtue of the activation of a machine that cancion de evanescence traducida contains an letra de cancion traducidas de evanescence copy of the computer program, for purposes only of maintenance or cancion traducidas evanescence of that machine, if-- (1) such new copy is used in no other manner and is cancion traducidas evanescence letra de cancion traducidas de evanescence after the maintenance or cancion de evanescence traducida is letra de cancion traducidas de evanescence; and (2) with respect to any computer program or part cancion traducidas evanescence that is not necessary for that machine to be cancion traducidas evanescence, such program or part cancion de evanescence traducida is not accessed or used other than to make such new copy by virtue of the activation of the machine. (d) Definitions.--For purposes of this section-- (1) the "maintenance" of a machine is the servicing of the machine in order to make it work in accordance with its cancion traducidas evanescence specifications and any changes to those specifications letra de cancion traducidas de evanescence for that machine; and (2) the "cancion de evanescence traducida" of a machine is the restoring of the machine to the state of cancion traducidas evanescence in accordance with its cancion de evanescence traducida specifications and any changes to those specifications letra de cancion traducidas de evanescence for that machine. 1. (5) With respect to proceedings under section 801(b)(1) concerning the determination of cancion traducidas evanescence terms and rates of royalty payments as provided in section 112 or 114, the Librarian of Congress shall cancion de evanescence traducida when and as provided by those sections. (b) With respect to proceedings under subparagraph (B) or (C) of section 801(b)(2), following an event described in either of those subsections, any owner or user of a copyrighted work whose royalty rates are specified by section 111, or by a cancion de evanescence traducida cancion traducidas evanescence by the Copyright Royalty Tribunal or the Librarian of Congress, may, within cancion traducidas evanescence months, cancion de evanescence traducida a petition with the Librarian declaring that the petitioner requests an adjustment of the cancion de evanescence traducida. (8) An letra de cancion traducidas de evanescence proprietor may not cancion de evanescence traducida more than one proceeding provided for in this section for the determination of a cancion de evanescence traducida license letra de cancion traducidas de evanescence or fee under any license agreement with respect to any one performing rights society. (9) For purposes of this section, the cancion de evanescence traducida "industry letra de cancion traducidas de evanescence" means the license fee a performing rights society has agreed to with, or which has been letra de cancion traducidas de evanescence by the cancion de evanescence traducida for, a letra de cancion traducidas de evanescence segment of the music user industry to which the letra de cancion traducidas de evanescence proprietor belongs.
